NestZim, a product of Fignoc Technologies and its associated parties ("NestZim", "we", "us", or "our") respects your privacy and is committed to handling personal information lawfully, fairly, transparently and responsibly. This Privacy Policy explains what personal information we collect, how we use it, when we share it, how long we keep it, and the choices and rights available to you.
This Privacy Policy applies to the NestZim website, mobile application, related online services, communications, property listings, account tools and support channels (together, the "Platform"). It should be read together with the NestZim Terms of Use and any other policy or notice that applies to a specific service or feature.
Important Platform Notice
NestZim is a property discovery and listing platform that helps tenants find homes and connect directly with landlords and agents. NestZim is not a landlord, estate agent, property manager, bank, escrow provider, payment intermediary, or party to any tenancy, lease or rental arrangement between users.
NestZim does not collect, hold, process, guarantee, refund or facilitate rent, deposits, viewing fees, handover payments, agency fees, lease payments or other payments between tenants, landlords or agents. Any rental payment, viewing arrangement, inspection, lease term, handover, refund, repair or dispute is agreed directly between the relevant tenant and landlord/agent.
NestZim may process payments made to NestZim for its own platform subscriptions, listing plans or platform services. Those platform fees are separate from rent, deposits or other tenant-landlord payments.

1. Who We Are and How to Contact Us
NestZim, a product of Fignoc Technologies and its associated parties, is responsible for deciding why and how personal information is processed for the Platform, except where landlords, agents, payment processors, verification providers, analytics providers or other third parties process information independently for their own purposes.

Where applicable law requires a data controller licence, data protection officer, representative, registration or similar compliance step, NestZim will maintain the required arrangements and records, and will update this Privacy Policy or provide additional notices where appropriate.
2. Scope of This Privacy Policy
This Privacy Policy applies when you access, browse, register for, list property on, search, enquire through, communicate through, pay NestZim platform fees through, or otherwise use the Platform.
This Privacy Policy does not apply to personal information processed independently by landlords, agents, tenants, payment processors, social login providers, map providers, analytics providers, WhatsApp, mobile network operators, banks, or other third-party services outside NestZim control. Those parties may have their own privacy notices, terms and legal obligations.
If you leave the Platform by using a third-party link, external payment method, telephone call, WhatsApp chat, social media page, map provider, advert, or other external service, that third party is responsible for its own privacy practices.
3. Selected Terms Used in This Policy
In this Privacy Policy:
• Personal information means information relating to an identified or identifiable natural person, including information that can identify a person directly or indirectly.
• Processing means collecting, recording, organising, storing, using, disclosing, making available, deleting or otherwise handling personal information.
• User means any person who uses the Platform, including tenants, landlords, agents, visitors and account holders.
• Tenant means a user who searches for, saves, reviews or enquires about rental properties.
• Landlord means a user who lists, manages or advertises a property for rent on the Platform.
• Agent means a real estate professional or agency user who lists, manages or advertises properties on the Platform.
• Listing means a property advertisement, property profile or rental listing published or submitted through the Platform.
4. Personal Information We Collect
We collect only the information reasonably necessary for the purposes described in this Privacy Policy, subject to the features you use, your account type, your device settings and your interactions with other users.
4.1 Information you provide directly
• Account information: full name, email address, phone number, password, role, account preferences and login credentials.
• Profile information: profile photo, biography, public display name, contact preferences, landlord/agent profile details and other information you choose to add to your profile.
• Landlord and agent verification information: identity documents, business registration information, proof of authority to list a property, agent licence details, professional profile details, address or contact information, and other documents needed for safety, compliance or verification.
• Listing information: property title, description, photographs, videos, price/rent, location, availability, features, amenities, rules, contact instructions and any other details included in a property listing.
• Tenant enquiry information: saved properties, search preferences, enquiry messages, viewing requests, contact details you share, and related communications.
• Messages and communications: in-platform messages, support emails, complaint details, reports, attachments and other communications sent to or through NestZim.
• Reviews, ratings and reports: ratings, written feedback, safety reports, fraud reports, moderation requests and evidence provided to support a complaint.
• Subscription and platform billing information: billing name, billing contact details, subscription plan, transaction reference, payment status and masked payment details for payments made to NestZim for platform services. We do not store full card numbers or full bank account credentials.
4.2 Information collected automatically
• Usage information: pages visited, searches performed, filters selected, listings viewed, links clicked, saved properties, enquiries sent, features used and user journey information.
• Device and technical information: IP address, device type, browser type and version, operating system, device identifiers, language settings, screen resolution, referral URLs and diagnostic data.
• Log and security information: server logs, login attempts, authentication records, error reports, fraud signals, suspicious activity records and security event logs.
• Location information: approximate city, suburb or region derived from your IP address or search settings; and precise location only where you give device-level permission for map or location-based features.
• Cookies and similar technologies: session cookies, preference cookies, analytics identifiers, security cookies, advertising or marketing cookies where permitted, and similar tracking technologies.
4.3 Information from third parties
• Social login providers: if enabled and used, your name, email address, profile picture and authentication status from the relevant provider.
• Payment processors: confirmation that a payment to NestZim was successful or failed, masked payment information, transaction reference and fraud prevention signals.
• Verification providers and public sources: identity, professional, licensing, business registration or property-authority information used to support landlord or agent verification.
• Analytics and advertising partners: aggregated, pseudonymous or device-level information used to understand traffic, improve the Platform, measure campaigns or prevent abuse, subject to consent requirements where applicable.
• Other users: complaints, reports, reviews, safety information or correspondence submitted by tenants, landlords, agents or visitors about a listing, account or interaction.
5. Sensitive Information and Information We Do Not Need
Some information can be sensitive, including national identity information, biometric information, financial information, health information, race or ethnicity, religious beliefs, political opinions, criminal history, precise location information, information about children, and private family or household information.
NestZim does not intentionally request sensitive information unless it is reasonably needed for verification, fraud prevention, safety, legal compliance, account security or another legitimate platform purpose. You must not upload or send unnecessary sensitive information through public listings, reviews, ordinary messages or support channels.
• Do not post full bank account details, card numbers, one-time passwords, account passwords, national ID copies, lease documents or private financial documents in public listing descriptions or public reviews.
• Do not upload photographs of other people, identity documents, title deeds, contracts or private documents unless you have the right to do so and the upload is necessary for the relevant Platform function.
• If we receive sensitive information that is not needed, we may delete, redact, restrict access to, or ask you to remove it.
6. How We Use Personal Information
We use personal information for the purposes described below:
• To create, authenticate, manage and secure user accounts.
• To display, organise, moderate, promote and manage property listings.
• To help tenants discover rental properties and connect directly with landlords or agents.
• To enable landlords and agents to list properties, manage enquiries and maintain professional profiles.
• To operate in-platform messaging, enquiries, alerts, saved listings, notifications and support features.
• To process NestZim platform subscriptions, listing plans, invoices, billing queries and receipts for services provided by NestZim only.
• To verify landlords, agents, listings or authority to list where necessary for safety, trust, legal compliance or fraud prevention.
• To detect, investigate, prevent and respond to fraud, abuse, scams, security incidents, suspicious listings, impersonation, unauthorised access and violations of our Terms of Use.
• To respond to support requests, complaints, reports, legal requests and user enquiries.
• To send service messages, account alerts, security notices, policy updates, subscription notices and operational communications.
• To send marketing communications where permitted and to honour opt-out requests.
• To analyse usage, improve search, improve listing quality, measure performance, test features and develop safer, more accessible property discovery tools.
• To comply with applicable laws, lawful requests, court orders, tax/accounting requirements, regulatory obligations and record-keeping duties.
• To establish, exercise, protect or defend the rights, property, safety and legitimate interests of NestZim, users or third parties.
7. Lawful Grounds for Processing
We process personal information only where we have a lawful reason to do so. Depending on the context, we may rely on one or more of the following grounds:
• Consent: where you have agreed to the processing, such as certain marketing communications, precise device location, optional cookies, optional profile information or certain sensitive information. You may withdraw consent at any time, subject to processing already carried out and any legal retention requirements.
• Providing the Platform and requested services: where processing is necessary to create your account, publish or manage listings, support enquiries, process NestZim platform subscriptions, provide support, or enable Platform features you request.
• Legal obligation: where processing is required to comply with applicable law, regulatory requirements, court orders, tax/accounting duties, lawful requests or safety obligations.
• Legitimate interests: where processing is necessary for platform security, fraud prevention, service improvement, direct user communications, listing moderation, analytics, rights protection or business administration, and those interests are not overridden by your rights and freedoms.
• Protection of rights and safety: where processing is necessary to protect users, prevent harm, investigate misconduct, enforce our Terms of Use, or establish, exercise or defend legal claims.
8. Public Listings, Profiles and Search Visibility
NestZim is designed to help people discover rental properties. For that reason, some information you submit may be visible publicly or to other users.
• Public listing information may include property photos, property descriptions, asking rent, property location, amenities, availability, landlord/agent profile details, ratings, reviews and contact or enquiry options.
• Public pages, including some listing pages, location pages, agent pages, landlord pages, guides and reviews, may be indexed by search engines such as Google and may appear in search results.
• You must not include unnecessary private or sensitive information in public fields. If you publish information publicly, search engines or third parties may store or cache it even after it is removed from NestZim.
• NestZim may remove, moderate or restrict visibility of content that violates the Terms of Use, this Privacy Policy, applicable law, safety rules or listing quality standards.
9. User Communications, Enquiries and Messaging
The Platform may allow tenants, landlords and agents to communicate through enquiry forms, message tools, phone-clicks, WhatsApp-clicks, email-clicks or other contact features.
• In-platform messages and enquiry records may be stored and reviewed by NestZim where necessary for support, safety, fraud prevention, dispute handling, Terms enforcement or legal compliance.
• NestZim does not control communications that occur outside the Platform, including direct phone calls, SMS, WhatsApp chats, email exchanges, bank communications or in-person conversations.
• Do not share passwords, one-time passwords, full card details, unnecessary identity documents or other sensitive information in ordinary user messages.
• If you report a user, listing or message, we may use the information you provide to investigate and may share limited details with the reported user, law enforcement, regulators, service providers or advisers where necessary and lawful.
10. Payments, Billing and Rent/Deposit Non-Facilitation
This section is important because NestZim may charge landlords, agents or other users for platform services, while rental payments between tenants and landlords/agents remain outside NestZim.
• Platform fees paid to NestZim: NestZim may collect or process information needed to bill and receive payment for NestZim subscriptions, listing plans, promotional features or other services provided by NestZim.
• Rental payments between users: NestZim does not collect, hold, process, facilitate, guarantee, refund, insure or mediate rent, deposits, viewing fees, lease payments, handover payments, repairs, damages, refunds, agency commissions or any other payments agreed between tenants, landlords or agents.
• Payment processors: When you pay NestZim for platform services, payment may be processed by independent payment providers. We receive transaction status, references and masked details, but we do not store full card numbers or full bank credentials.
• User responsibility: Before making any rental-related payment to a landlord, agent or tenant outside NestZim, you should verify the property, identity, authority to let, payment details and agreed terms directly with the relevant party.
• Fraud reports: If you suspect a fraudulent payment request, false listing, impersonation or scam, contact NestZim support/legal promptly so we can review the relevant account or listing.
11. How We Share Personal Information
We do not sell personal information. We may share personal information only as described below:
• With other users as part of the Platform: for example, public listings, public profiles, reviews, enquiry details and contact information you choose to share with landlords, agents or tenants.
• With service providers: including hosting providers, cloud storage providers, email/SMS providers, analytics providers, customer support tools, security tools, verification providers, payment processors and technical contractors who help us operate the Platform.
• With payment processors: to process payments made to NestZim for platform services, prevent payment fraud, handle chargebacks, reconcile accounts and comply with financial requirements.
• With verification, safety and fraud-prevention partners: to assess identity, account legitimacy, agent/licence status, landlord authority, suspicious activity or listing risk.
• With regulators, courts, law enforcement and public authorities: where required or permitted by law, lawful process, court order, regulatory request, fraud investigation, safety concern or rights protection.
• With professional advisers: including lawyers, auditors, insurers, accountants, cybersecurity advisers and other professional consultants where needed for business, compliance or legal purposes.
• With business successors: if NestZim is involved in a merger, acquisition, financing, restructuring, sale of assets or transfer of all or part of the business, subject to appropriate confidentiality and privacy protections.
• With your consent or instruction: where you ask us to share information or where we give you a choice and you agree.
12. Landlords, Agents and Tenants as Independent Recipients
When tenants, landlords and agents communicate with one another, each party may receive personal information about the other. For example, a tenant may share a name and phone number when enquiring, and a landlord or agent may share viewing details, address information or availability information.
Landlords and agents may independently process tenant information for viewings, screening, lease negotiations, tenancy administration or their own legal obligations. Tenants may independently process landlord or agent contact information to communicate about a property. NestZim is not responsible for how users process information outside the Platform.
• Landlords and agents must only collect, use, store and share tenant information lawfully and fairly.
• Users must not misuse personal information obtained through NestZim for spam, harassment, discrimination, unlawful screening, fraud, identity theft, unauthorised marketing or any purpose unrelated to genuine property rental activity.
• A landlord or agent should not ask for unnecessary sensitive personal information before a tenant has had a reasonable opportunity to verify the property, the landlord/agent identity and the purpose of the request.
13. Cookies, Analytics and Similar Technologies
We use cookies and similar technologies to operate the Platform, remember preferences, improve performance, protect accounts, understand usage and support lawful marketing. Cookies may be set by NestZim or by approved third-party service providers.
• Essential cookies: needed for login, security, session management, fraud prevention, load balancing and core Platform functionality.
• Preference cookies: used to remember settings such as language, location, currency, saved filters or display choices.
• Analytics cookies: used to understand how users interact with the Platform, measure traffic, diagnose issues and improve features.
• Marketing cookies: used to measure campaigns or show relevant messages, only where permitted by law and your consent settings.
You can manage cookies through your browser settings and any cookie tools made available on the Platform. Disabling essential cookies may prevent some features from working properly.
14. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law, fraud prevention, safety, dispute resolution, accounting, tax, audit, backup or legal purposes.

15. Data Security
We use reasonable technical and organisational measures designed to protect personal information against unauthorised access, loss, misuse, disclosure, alteration or destruction. These measures may include:
• HTTPS/TLS encryption for data transmitted through the Platform.
• Password hashing and access controls for account and administrative systems.
• Role-based access controls and internal access limits for staff, contractors and service providers.
• Logging, monitoring and investigation of suspicious activity.
• Security reviews, patching, backups and vulnerability management appropriate to the Platform.
• Confidentiality obligations for staff and service providers who access personal information.
No website, app, database or transmission method is completely secure. You are responsible for using strong passwords, keeping your login details confidential, logging out on shared devices, and promptly reporting suspected unauthorised access or suspicious activity.
16. International Transfers
NestZim and its service providers may store, process or access personal information in Zimbabwe or in other countries where cloud hosting, security, analytics, email, payment, support or technical providers operate. Privacy and data protection laws may differ between countries.
Where personal information is transferred outside Zimbabwe, we will take steps required by applicable law and reasonably appropriate safeguards, such as contractual protections, security measures, due diligence on service providers, and transfer arrangements designed to protect the information.
17. Your Privacy Rights and Choices
Subject to applicable law, identity verification, reasonable limitations and legal retention obligations, you may have the following rights and choices:
• Right to be informed: to understand how your personal information is collected, used and shared.
• Access: to request access to personal information that NestZim holds about you.
• Correction: to ask us to correct inaccurate, incomplete, false or misleading personal information.
• Deletion: to ask us to delete personal information where there is a lawful basis to do so, subject to retention obligations and legitimate platform needs.
• Objection: to object to certain processing, including direct marketing and certain processing based on legitimate interests.
• Restriction: to ask us to restrict certain processing in appropriate circumstances.
• Withdrawal of consent: to withdraw consent where processing is based on consent, without affecting lawful processing already carried out.
• Portability or copy request: to ask for a copy of certain information in a reasonable format where technically feasible and legally appropriate.
• Complaint: to raise a complaint with NestZim and, where applicable, with the Postal and Telecommunications Regulatory Authority of Zimbabwe (POTRAZ) or another competent authority.
To exercise a privacy right, contact legal@nestzim.co.zw. We may need to verify your identity, understand your request, ask for additional information, or decline/limit a request where the law allows or requires us to do so. We aim to respond within 30 days where practicable, unless a different period applies by law or a request is complex.
18. Marketing Communications
We may send marketing messages about NestZim features, listing tools, landlord/agent plans, rental guides, safety tips, promotional offers, service updates or relevant property discovery content where permitted by law.
• You can opt out of marketing emails by using the unsubscribe link in the message or contacting us.
• You may still receive non-marketing messages, such as account security alerts, service notices, transaction receipts, legal notices, policy updates and support responses.
• We do not sell your contact details to landlords, agents, advertisers or unrelated third parties for their own marketing.
19. Children and Minors
The Platform is intended for users who are at least 18 years old and have legal capacity to use the Platform. NestZim does not knowingly collect personal information from children or knowingly allow children to create accounts.
If you believe a child or minor has provided personal information to NestZim, contact legal@nestzim.co.zw. We will review the matter and take appropriate steps, which may include deleting the information, closing the account or contacting a parent/guardian where necessary and lawful.
20. Accuracy of Information and User Responsibilities
You are responsible for keeping your account, profile, listing, contact and payment information accurate, current and complete. Inaccurate information may affect your ability to use the Platform, receive enquiries, verify your account or access support.
• Landlords and agents must ensure listings, property photos, availability, prices and contact details are accurate and lawful.
• Tenants should ensure enquiry details and contact information are accurate and should verify property details directly with the landlord or agent before making commitments.
• Users must not submit another person's personal information unless they have lawful authority or consent to do so.
• Users must not use information obtained through NestZim for unlawful discrimination, harassment, threats, scams, spam, unauthorised marketing or fraud.
21. Automated Tools, Search Ranking and Moderation
The Platform may use automated or semi-automated tools to support search ranking, property recommendations, listing quality checks, fraud detection, spam prevention, account security, moderation queues, analytics and operational decision-making.
These tools are intended to improve safety, relevance and user experience. We do not intend to make decisions based solely on automated processing that produce legal effects or similarly significant effects on you without appropriate safeguards, unless permitted by law. Where an automated or semi-automated action affects your account or listing, you may contact us for review where appropriate.
22. Data Breaches, Safety Reports and Incident Response
If we become aware of a security incident involving personal information, we will assess the nature and scope of the incident, take reasonable containment and remediation steps, investigate the cause, preserve relevant records, and notify affected users, regulators or other parties where required by applicable law.
If you suspect your account has been compromised, a listing is fraudulent, someone is impersonating a landlord/agent/tenant, or a payment request looks suspicious, contact us promptly at legal@nestzim.co.zw or through the available support channel.
23. Third-Party Links, Maps, Social Tools and External Services
The Platform may include links or integrations with third-party services, including maps, analytics, payment processors, social login providers, WhatsApp, email tools, phone links, social media pages, advertising networks, and external websites.
NestZim is not responsible for the privacy practices, security, content, availability, representations or payment practices of third-party services. You should review the privacy policies and terms of those third parties before using them or sharing information with them.
24. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect legal, technical, operational or business changes. When changes are material, we will take reasonable steps to notify users, such as by email, in-app notice, website notice or another appropriate method, before or when the changes take effect.
The updated Privacy Policy will apply from the effective date stated in the updated version. Continued use of the Platform after the effective date means you acknowledge the updated Privacy Policy.
